SLINGSHOT SPORTS DEMO EVENT WAIVER FORM

RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS,

INDEMNITY AND RENTAL AGREEMENT

WARNING: BY SIGNING THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. PLEASE READ CAREFULLY

To: Slingshot Sports, LLC dba Slingshot, and/or Ride Engine, the Manufacturers and Distributors for any Equipment used in any Demo Event and Test Ride programs, and to all sponsors and promoters of these programs (all of whom are hereinafter collectively referred to as the “Sponsors”).

DEFINITIONS:

In this agreement

The terms “Demo Event” or “Test Rides,” or any derivation thereof, (hereinafter referred to as the “Demo Program”) shall include any Kiteboarding, Wakeboarding, Wakesurfing, Foilboarding, Windsurfing, Skateboarding, Paddleboarding, or other similar activities sponsored or supported by the Sponsors for the purpose of promotion, or for testing or evaluating equipment manufactured, distributed or provided by the Sponsors.
The term “Equipment” shall include all kites, kiteboards, wakeboards, wakesurfboards, foils, foilboards, windsurf boards, skateboards, paddleboards, components, parts, safety equipment including helmets, tools, clothing or accessories manufactured, distributed or provided by the Sponsors for use in the Demo Program; and
The terms “Sponsors” and “Manufacturers and Distributors” shall include all individuals, corporations, or organizations that manufacture, distribute, represent for sale, sponsor, promote, or make available any Equipment to be used in the Demo Program.

SAFETY CONSIDERATIONS

I am familiar with the proper use of the Equipment provided to me to use, including all binding and release mechanisms. I acknowledge that I have been advised to wear an approved helmet and other appropriate safety gear while participating in the Demo Program. I am aware that while using the Equipment I may be subject to applicable federal, state, and/or municipal traffic or waterway regulations, and I will at all times comply with those regulations.

ASSUMPTION OF RISK

I am aware that my participation in the Demo Program involves many risks, dangers, and hazards. To the fullest extent authorized by law, I accept any and all risks of my participation in the Demo Program, including but not limited to: changing weather and water conditions; variation of

steepness in terrain; collision with man-made or natural objects; and collision with pedestrians, vehicles, boats, or other individuals engaged in similar activities. I also assume and accept the negligence of the Sponsors, the Manufacturers and Distributors, and their staff, including their failure to safeguard or protect me from the risks, dangers and hazards mentioned above. I freely accept and fully assume all such risk, dangers and hazards and the possibility to personal injury, death, property damage and loss resulting therefrom.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

In consideration of being permitted to participate in the Demo Program, I hereby agree as follows:

1. TO WAIVE ANY AND ALL CLAIMS that I have or may have in the future against the Sponsors, the Manufacturers and Distributors, and their directors, officers, employees, agents and representatives, successors and assigns, (all of whom are hereinafter collectively referred to as the “Releasees”) and to RELEASE THE RELEASEES from any loss, damage, injury or expense that I may suffer, or that my next of kin may suffer, as a result of or arising out of any aspect of my participation in the Demo Program, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT OR BREACH OF WARRANTY ON THE PART OF THE RELEASEES in respect to the design, manufacture, selection, maintenance or adjustment of the Equipment or in respect of the provision of or the failure to provide any warnings, directions, instructions or guidance as to either the use of the equipment of participation in the Demo Program.

2. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any loss, damage injury or expense to any third party, resulting from my use of the equipment or participation in the Demo Program.

3. This agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity.

In entering into this agreement I am not relying on any oral or written representations or statements made by the Releasees with respect to the safety of participating in the Demo Program, other than what is set forth in this agreement.

I HAVE READ AND UNDERSTAND THIS AGREEMENT. I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS AND ASSIGNS MAY HAVE AGAINST THE RELEASEES.
